GENERAL TERMS AND CONDITIONS RADIOBEURS TILBURG
1. Definitions and Applicability
1.1. The Radiobeurs: the legal entity, having its registered office in Tilburg, actually located in Tilburg at Heuvelstraat 127-129.
1.2. The customer: any natural or legal person with whom the Radiobeurs enters into a contract.
1.3. Agreement: all agreements made between the Radiobeurs and the customer through the web store of the Radiobeurs (http://www.radiobeurs-tilburg.nl/).
1.4. Withdrawal period: period of 14 working days during which the customer can terminate the agreement without giving reasons and return the product in its original packaging and undamaged.
1.5. These general terms and conditions apply, to the exclusion of any other general terms and conditions, to every offer, quotation or agreement between the Radiobeurs and the customer.
1.6. Any deviations from these general terms and conditions are only valid if they have been expressly agreed in writing prior to the conclusion of an agreement.
1.7. If one or more provisions contained in these general terms and conditions or an agreement concluded between the customer and the Radiobeurs are null and void or should be annulled, the other provisions of these general terms and agreement shall remain in full force and effect. In that case the Radiobeurs will consult about a new provision that will replace the void or annulled provision, taking into account as much as possible the purpose and purport of the original provision.
2. Offers, prices and quotations
2.1. All offers are without obligation, unless explicitly stated otherwise in writing in the offer.
2.2. The prices in the mentioned offers and quotations are in euros and inclusive of VAT, but exclusive of the legally required contributions, such as the disposal fee, and shipping, connection or delivery costs, unless explicitly stated otherwise.
2.3. Sales prices are indicated with the product in question.
2.4. If an incorrect price is stated for a product, the Radiobeurs will not be bound by this incorrect price statement.
2.5. All quotations issued by Radiobeurs are valid for a period of 14 days and expire automatically on expiry of that period, unless otherwise stated. The Radiobeurs also reserves the right to withdraw an offer before the offer is accepted by the customer. In the above cases, the customer can no longer rely on that offer in and out of court.
3. Realization of agreement
3.1 The agreement is concluded at the time of acceptance by the consumer of the offer and compliance with the corresponding conditions. The Radio Radiobeurs can investigate the creditworthiness of the customer, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, the Radiobeurs has good grounds not to enter into the contract, it will refuse an order or application, stating its reasons, or attach special conditions to the implementation.
3.2 After conclusion of the agreement by electronic means, the Radiobeurs shall send an electronic confirmation of the order.
3.3 The Radiobeurs shall provide appropriate technical measures to protect the electronic transfer of data with respect to the conclusion of the agreement and the subsequent payment.
4. Right of revocation
4.1 The customer has the possibility to dissolve the agreement within 14 working days and without giving reasons. This dissolution period commences on the day after the customer has received the ordered product(s).
4.2 The customer is obliged to handle the product and packaging with care during the revocation period.
4.3 If the customer exercises the right of revocation, the product including all delivered accessories must be returned undamaged and in the undamaged original packaging.
4.4 The costs for returning the product after the customer has exercised the right of revocation will be borne by the customer.
4.5 If the customer has already paid (part of) the amount for the delivered product, the Radio Radiobeurs will refund this amount as soon as possible, but at the latest within 14 days after the product has been returned.
4.6 If in a certain case the right of withdrawal is excluded, the Radiobeurs will explicitly report this before concluding the agreement with the customer.
5. Warranty
5.1 The Radiobeurs guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement.
5.2 A guarantee scheme offered by the Radiobeurs, the manufacturer or the importer does not affect the rights and claims that the consumer may assert in respect of a shortcoming in the fulfilment of the obligations of the Radiobeurs towards the Radiobeurs under the Act and/or the remote agreement.
6. Delivery
6.1 The Radiobeurs shall exercise the greatest possible care in the execution of the agreement.
6.2 Delivery takes place at the address provided by the customer.
6.3 The Radiobeurs shall ship the ordered product(s) as soon as possible. Products ordered shall be delivered within 30 days after the agreement has been made, unless another delivery period has been agreed with the customer. If the Radiobeurs is not able to meet this delivery period, it will inform the customer immediately. In that case, the customer has the right to dissolve the agreement at no cost. Amounts already paid by the customer will be refunded by the Radiobeurs within 14 days at the latest.
6.4 In case an ordered product turns out to be no longer available, the Radiobeurs will, if possible, make a proposal for the delivery of a comparable replacement article.
7. Payment and retention of title
7.1 Payment must be made within 14 days after the product(s) ordered have been delivered, unless a different term has been agreed in writing prior to the conclusion of the agreement.
7.2 The Radiobeurs can ask the customer to make a prepayment of up to 50% of the total amount. If it appears that a product is not available or the order cannot be executed for another reason, the Radiobeurs will refund the prepayment within 14 days to the customer.
7.3 The customer is obliged to provide the Radiobeurs with the correct payment information and if this information changes, to notify the Radiobeurs immediately.
7.4 In case of non-payment by the customer, the Trade show has the right, subject to legal restrictions, to charge any reasonable costs incurred / to be incurred in connection with the non-payment to the customer.
7.5 Delivered products remain the property of the Radiobeurs until the customer has fulfilled his payment obligation.
8. Disputes and Applicable Law
8.1 If the customer is dissatisfied with the execution of the agreement, the customer must notify the Radiobeurs in writing within a reasonable time after detection of the defects, fully and clearly described.
8.2 A complaint submitted to the Radiobeurs shall be answered within a period of 30 days from the day of receipt of the complaint by the Radiobeurs, or the receipt of the complaint shall be confirmed within this time with an indication when the customer can expect an answer.
8.3 A possible complaint can also be submitted by the customer by e-mail.
8.4 All agreements between the Radiobeurs and the customer to which these general terms and conditions apply, are exclusively governed by Dutch law.
